Terms of Service

Who we are

The Managed Website Service is provided by Kabooly Ltd, a company registered in the United Kingdom (company number 15653819), of 23 Carisbrooke House, Seven Kings Way, Kingston Upon Thames, KT2 5BS. By paying for the service you agree to these terms.

What is included

• Design and build of your website
• Hosting and an SSL certificate
• Your domain name, registered and renewed for you
• Business email at your domain
• Regular content updates and maintenance
• Technical support

Content updates and maintenance are included at no extra charge. If requests become excessive or fall outside the spirit of a managed service, we will talk to you about the scope.

Price and payment

• The service costs £50 a month, or is included in the Kabooly bundle
• You pay monthly in advance by card through Stripe, starting on the day you buy
• There is no setup fee
• Your monthly price stays fixed for the first 24 months. After that we may review it, and we will give you at least 60 days written notice of any change
• If a payment is more than 30 days overdue, we may suspend the service until it is paid

Who owns the website

For the first 12 months, we own the website, including the code, design and anything else we create for it. You can use it, but it is not yours yet.

After 12 months, and as long as every payment has been made, you can ask us to transfer ownership to you. You then receive the website's files and take full control of them. Hosting them somewhere else becomes your responsibility, and we no longer provide the service unless we agree otherwise.

Anything you give us, such as your logo, documents and photos, stays yours at all times.

Cancelling

You can cancel at any time by giving 30 days notice by email to [email protected].

• In the first 12 months: the website stays with us, and payments already made are not refunded
• After 12 months: you can take ownership of the website, as described above, and your monthly payments stop

Your domain and email

If we registered your domain name for you, we will transfer it to you when the service ends, as long as every payment has been made. Your business email addresses belong to your domain, so they move with it. The email service we run stops when the service ends, so you will need your own email provider from then on. If you registered your own domain, there is nothing to transfer.

If we end the service

We may end the service by giving you 30 days written notice. We may end it straight away if payments are not made or you seriously break these terms.

Your content

You confirm that you own, or have permission to use, everything you give us for your website, including images, logos and text. You agree to cover any claims, losses or costs that arise because content you supplied infringes someone else's rights.

Data protection

Where your website handles personal data for you, such as contact form submissions sent by email, you are the data controller and we are the data processor under UK GDPR and the Data Protection Act 2018. We only process that data to provide the service, keep it secure, and do not share it except where needed to provide the service or where the law requires. We are registered with the Information Commissioner's Office (registration number ZC086840).

Our liability

Nothing in these terms limits liability that cannot be limited by law. Otherwise, our total liability is limited to the amount you have paid us for the service, and we are not liable for anything arising from the website once ownership has been transferred to you.

Changes to these terms

We may update these terms. We will post the new version on this page and update the "Last updated" date.

Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
